Bigotry on the Arizona Ballot

Former Arizona State Senate President Russell Pearce was thrown out of office in a rare successful recall election last year. He is running in a new Senate district against a decent, intelligent, successful rival for the August GOP nomination for the District 25. Popular U.S. Senator John Kyle has nailed the final nail in Pearce’s political coffin by endorsing candidate Bob Worsley who, Kyle says, is a “solid conservative.”

Just in case, however, we need to discuss Pearce’s profound racism that he exhibits towards Mexicans, Mexican Americans and even legal day-visitors from Mexico spending money in Arizona and, worst of all, newborn babies. Babies born in the United States, natural born U.S. citizens with Mexican parentage are absolutely hated by Pearce.

The American Civil liberties Union (ACLU) has released e-mails written by then Senator Pearce that reflect profound hatred of Mexicans. The ACLU demanded all e-mails of Pearce’s while he was a state senator under Arizona’s “Freedom of Information” law. Let us see how Pearce really thinks.

After a protest march by 20,000 Hispanics in Phoenix, Pearce wrote: “[m]ost of the protestors are not legal citizens, legal residents, or even legal visitors in our country. They are illegal. They have no right to request or demand anything.” (Email from Sen. Pearce dated Apr. 6, 2006).

Question: Other than brown skins how would Pearce know that “most” of the protesters were in the U.S. illegally? He could not possibly know.

Pearce: “I’m a racist because . . . I don’t want to be taxed to pay for a prison population comprised of mainly Hispanics, Latinos, Mexicans or whatever else you wish to call them . . . I object to having to pay higher sales tax and property tax to build more schools for the illegitimate children of illegal aliens,.[I] want to deny citizenship to all anchor babies born in this country pre 2006 and here after . . . I object to corporation and municipalities spending billions to translate everything in Spanish.”

Question: What part of the Constitution’s 14th Amendment that declares that “all persons born or naturalized in the United States” are citizens, period, does Pearce not understand? How does he separate “illegitimate children of illegal aliens” from the illegitimate 30% or so of White babies or 70% of Black babies born? They are all Americans if born here. Just a note: Most immigration-hold prison inmates in Arizona or anywhere in the country exceed California’s 10%. So, how does semi-literate Pearce says prison populations are “mainly Hispanics?”

Pearce e-mail dated January 29, 2007, which reads in part:

The United States faces the greatest internal threat to its existence since the Civil War. It faces disintegration of its culture; of its language; of its cohesiveness as a nation of free people. It faces massive infusion of unrelenting poverty; of crime; of diseases; of civil violence; of corruption at all levels; and worst of all, the United States faces balkanization that will destroy the fabric of its ability to function as a peaceful nation.

WOW! We are doomed.  The percentage of illegal residents in the country is currently contracting and is below 4% of the total 310 million people in America today. WOW! We are doomed. Thanks for the warning Mr. Pearce (can’t call him senator any longer because he was thrown out of office).

Same e-mail: “Last week, Denver’s illegal aliens sang our national anthem in Spanish and bastardized the words of OUR country’s most sacred song. Talk about audacious, arrogant and condescending!”

WOW!

Pearce, same e-mail: “Tell me if you think they are becoming Americans. Ladies and gentlemen; this is an invasion by a foreign country.”

WOW! He should tell that to the almost 20% of the United States Marine combat arms that are either Mexican or Mexican American.

Pearce in the same e-mail: “(Then) Mexico’s Vicente Fox is no longer satisfied with the status quo. Battles commence as Mexican nationalists struggle to infuse their men into American government and strengthen control over their strongholds. One look at Los Angles (sic) with its Mexican-American mayor shows you Vicente Fox’s general Varigossa (sic) commanding an American city.”

L.A. Mayor Villaraigosa would be surprised to learn he commands anything and one has to say he probably never heard of Vicente Fox until he was elected President of Mexico. Villaraigosa and Fox don’t share any political philosophy.

Pearce: “They’ve started out as lawbreakers, they’re criminals. They have violated our law; they’ve trespassed in our nation. And they have attitudes.”

Howling-funny of the disgraced former state senator to declare that “They” have violated our laws, while he was fired from his job as Arizona Motor Vehicle director because he tolerated departmental law breaking, and as senator accepted $40,000 worth of illegal “gifts” from an admitted criminal who ran a criminal enterprise. That’s “attitude.”

GOP Group Reacts to Disbarment of Joe Arpaio Hand Picked County Attorney

Tucson, Arizona – We applaud today’s Arizona Bar Association Disciplinary Panel decisions to disbar former County Attorney Andrew Thomas and his deputy Lisa Aubuchon, and to suspend the law license of Rachel Alexander for six months, for their role in the malicious prosecutions of Joe Arpaio’s critics and opponents, intended to intimidate them into silence. Andrew Thomas was Joe Arpaio’s hand-picked County Attorney and right-hand man, elected with heavy backing from Joe Arpaio.

We look forward to justice for Joe Arpaio, who has not yet been indicted or charged in this scandal, though clearly he is a central figure in this repugnant behavior. Arpaio is always talking about upholding the ‘rule of law’, yet his conduct in this scandal reflects badly on his office and shocking lack of integrity. This ugly chapter in Arizona history will not be closed until Joe Arpaio is also held accountable for his utterly disgraceful conduct.

We also call on Joe Arpaio to resign and leave the Republican Party, as his values clearly are not representative of the party of Abraham Lincoln and Ronald Reagan. As Republicans, we believe in the ‘rule of law’ and personal responsibility, and the ‘rule of law’ does not include abusing one’s authority to persecute one’s critics to intimidate them into silence.

As of today, there are no other registered Republicans in the race for sheriff of Maricopa County, but with Arpaio out of the race we hope that a qualified Republican candidate will enter the race. Joe Arpaio is not fit to serve.

Not since the armies of the United States and Mexico chased Apache hero Geronimo all over Arizona and Northern Mexico has the United States paid much attention to Arizona until a car bomb killed a reporter who was investigating deep corruption of Arizona Republican politicians who were bought and paid for by gambling interests.

The bomb’s target died and Arizona press reporters mobilized to expose his murderers and in the process started a deep political anal examination that would eventually run two Republican governors out of office and into jail.

The state’s well-connected non-profit Fiesta Bowl Association’s bowl game would be exposed for a corrupt organization that had politicians enjoying five-star hotels (e.g.: in Chicago) and who-knows-what-else on tax free dollars including State Senate President – Russell Pearce — who the press exposed for taking $40,000 in “goodies” that led along with other political foibles to his being thrown out of office by his district voters.

To prove the deep-seated corruption of Arizona politics, that same recalled State Senate President had previously been fired from his governor-appointed job as Director of the state’s Motor Vehicle Department for criminally tampering with a woman’s driving record. Why? That was a felony. Unfortunately he was not prosecuted for political reasons.

Now, a new investigation is under way of the newly elected (2010) state Attorney General of Arizona, Republican Tom Horne, for illegally working with a Political Action Committee on fundraising, comingling of funds and campaign direction of his campaign. Already under the microscope for appointing a woman lawyer to a lucrative job in his office who has been in legal trouble with the State Bar more than once and has demonstrated that she is a terrible lawyer,

Attorney General Tom Horne previously served as the State Superintendent of Education and banned teaching of subjects he doesn’t care for in the Tucson schools that are available all over the Southwest. That case is in the courts.

Into this cesspool of corruption AKA The State of Arizona is the continuing saga of Sheriff Joe Arpaio, the 78-year-old former federal drug cop who runs the Maricopa County Sheriff’s Office (MCSO) in and around Phoenix. He has been investigated by the federal government starting with complaints filed in 2008 to the Bush Department of Justice that accused him of running the worst racial profiling department in the entire country – an illegal activity by any department.

Famous for massive raids on Hispanic neighborhoods in his 24/7 hunt of illegally present aliens, specifically those of the Mexican bloodline, the irascible sheriff is to be dragged into court. A judge has ordered a July 19 trial for the case of Melendez v. Arpaio in which Arpaio is being sued for racial profiling which is illegal by all public agencies, including Arpaio’s MCSO.

This is bad news for Arpaio for he stalked out of a mediation conference with the federal government recently. It was ordered when the federal government released a report of the illegal racial profiling used by Arpaio deputies. He continues his hysterical hunt for bus boys, dishwashers, plant-tending nursery workers and waitresses.

The federal government will now sue. Arpaio says he will fight with taxpayer dollars, of course.

Arpaio’s next door neighboring Sheriff Paul Babeu (Boo-Boo) is being investigated by the State and Federal governments for allegedly threatening his former boy friend the (self-admitted) homosexual sheriff dumped when he announced for a congressional Republican nomination.

Amidst investigations, extensive racial profiling and massive corruption that has sent two governors to prison, the disgraced recalled former State Senate President Pearce has announced a run for a new unoccupied state senate seat this fall.

Worse, his pet project, the anti-illegal alien/immigrant SB 1070 law, will be scrutinized by the U.S. Supreme Court after it has been stopped cold by an Arizona federal judge and the 9th Circuit Court of Appeals.

The corrupt State of Arizona, its corrupt Republican Party, a failed politician that was fired for committing felonies as Director of the state Motor Vehicle Department and recalled by voters, lie exposed under a bright sun’s light in more ways than one.

Currently being offered by those very same corrupt legislators and politicians is a bill that would punish “offensive” “offending” online speech, photos and references that tend to aggravate or bother people like former State Senate President Russell Pearce or Sheriffs Arpaio or Boo-boo or Attorney General Horne – like this very article. It will be e-mailed to over 600 newspapers, media and readers. In Arizona under this proposed law I could be arrested.

Arizona may or may not be a good place to visit or to do business in but it obviously is not a good place in which to live if one has brown skin and/or believes in the U.S. Constitution that is respected by 49 other states.

P. T. Barnum’s oft-quoted “There’s a sucker born every minute” is appropriate today in the US of A. Why? Because of illegal immigration that has generated an April session in the Supreme Court of the United States on the State of Arizona’s declaration of war on the United States and the Constitution that formed and governs the country.

Defenders of Arizona’s anti-Mexican SB 1070 law often insist that the infamous law enjoys considerable public support. It certainly doesn’t have much support in the federal courts what with an Arizona-based federal district judge stopping the law’s critical provisions cold. The 9th Circuit upheld the judge’s injunctions and now those injunctions are up for review by the United States Supreme Court.

Most polls taken after the law’s passage showed something between 60 and 70% public support nationally. Of course, most people are ignorant of the Constitution as a whole in particular of Article 1, Section 8 which explicitly enumerates the power of the United States Congress “to establish a uniform rule of naturalization,” which means immigration.

Millions of people are unaware of the constitutional congressional mandate on naturalization/immigration, nonetheless P.T. Barnum “suckers” line up to support the Arizona law, especially the “usual suspects” who apparently lack detailed knowledge of the Constitution.

When I speak, I speak of people like Bill O’Reilly at Fox News and Laura Ingrahm, Rush Limbaugh, Sean Hannity of radio fame and myriad other constitutionally unread public figures, the “suckers.”

There really aren’t that many suckers because if there were the Supreme Court would have been inundated by mountains of legal briefs supporting Arizona’s law. It wasn’t and those that were submitted look like “cut and paste” jobs by legal shops that represent a monolithic Arizona defense that is at best ludicrous and unconstitutional in spirit and in word. These silly supporting briefs are mostly from ultra-conservative congress people, a few other conservative officials and a number of hate groups organized by the country’s most active racist, Dr. John Tanton. These are hate groups like FAIR and its non-profit arm, the Center for Immigration Studies (organized by Tanton to fight any immigration including legal especially Catholics from Mexico).

Numerous well-known and influential outside parties oppose the law:

  • Sixteen current and former chief law enforcement officers filed briefs opposing SB 1070, including the former Phoenix police chief and the sheriff of Pima County, Arizona, which shares a longer border with Mexico than any county in Arizona. Two law enforcement officials – only – filed supporting SB 1070, including Maricopa County Sheriff Joe Arpaio who is being investigated by the federal government that accuses his deputies of the worst racial profiling in the country.
  • One brief filed to oppose SB 1070 was joined by a former Secretary of State (Madeline Albright, Democrat), a former Secretary of Defense (William Cohen, Republican), and two former ambassadors to the United Nations (Albright and John Negroponte, Republican).
  • Another was submitted on behalf of two former commissioners of the Immigration and Naturalization Service (Doris Meissner, Republican and James Ziglar, Republican). No member of any prior Presidential administration (Reagan, Bush I, Clinton, Bush II) joined a brief supporting SB 1070.
  • Eleven states with a combined population of nearly 100 million—submitted a brief opposing SB 1070, including California, New York, and Illinois. More than 40 cities and counties filed opposition to 1070, three of which are in Arizona (Tucson, Flagstaff, and San Luis).
  • A brief filed on behalf of 68 pro-immigrant members of Congress was joined by Minority Leader Nancy Pelosi and other high-ranking members of the House Democratic leadership. No member of the House Republican leadership signed a pro-SB 1070 brief filed on behalf of fifty conservative lawmakers.
  • The government of Mexico filed opposition to SB 1070 that was joined by sixteen other Latin American countries.
  • Finally, a dozen briefs were filed on behalf of more than 50 national organizations ranging from the ultra-liberal ACLU, to the AFL/CIO, the U.S. Conference of Catholic Bishops and the conservative U.S. Chamber of Commerce.

Briefs here, briefs there, briefs everywhere. None with pro-signatures from the Republican Congressional leadership, none with pro-Governors other than the high school-only educated Arizona governor who did not attend a four year college or took academic college courses even in community college unless they came under her medical office worker certificate program.

The law’s sponsor, Russell Pearce (who was the Arizona Senate President then) was flushed down a recall toilet last November when his conservative constituency threw him out of office.

Arpaio is being investigated by the feds for alleged criminal acts. SB1070 supporting Arizona sheriff Paul Babeu (Boo-Boo) is also being investigated for criminal acts.

Support for and supporters of SB1070 are narrow in scope and numbers. Question: do they have five “sucker” supporters on the Court?

Another Latino Killed by Arpaio’s Jailers. GOP Group Calls on Brewer to Step in

Phoenix, Arizona – Tragically, a Latino U.S. Citizen and veteran, Martin Atencio, was brutally tasered at Arpaio’s jail and is now on life-support at the hospital. Our condolences to the family. Maricopa County taxpayers have already paid out over $43 million in wrongful death lawsuits, and despite earlier DOJ intervention the beatings continue. There has also been an alleged pattern of obstruction, etc. in previous wrongful death cases, and we see no reason why the investigation into this case will be any different under Arpaio. How many more death sentences will be meted out by Arpaio’s guards before there is accountability?

Maricopa County Sheriff Joe Arpaio, despite a chorus of calls for his resignation, has stated he will never resign, and it is plainly obvious from his rhetoric he has no intention of implementing badly needed reforms, and instead blames others for his own leadership failings and incompetence.

The DOJ plans legal action if Arpaio does not agree by January 4th, and Maricipa County stands to lose tens of millions in federal aid ($15 million in 2010), at a time taxpayers can ill afford a tax hike or deep cuts in services. Arpaio blocked the recent DOJ investigation for an entire year by refusing to cooperate, and now blames the DOJ for the report timing, though still 11 months before the elections. We see no reason Arpaio will suddenly begin to cooperate in making changes after refusing to turn over documents or allow his staff to talk with investigators until the DOJ filed a lawsuit.

Arpaio’s incompetence in not investigating hundreds of sex crimes, and refusal to follow the U.S. Constitution, an integral part of the ‘rule of law’, have become an extreme embarrassment for Arizona. What part of “illegal” doesn’t Joe Arpaio understand?

In 2010, two Maricopa County Board Supervisors called for the MCSO to be placed in federal receivership, to no avail. The DOJ recently issued an extremely critical report, which includes brutality and cruelty against Latinos in particular, to no avail.

Drastic action is needed before any more prisoners are severely beaten or killed. We call on Governor Brewer to place the MCSO in receivership, with a senior level career Arizona DPS official placed in charge. We request that the Maricopa County Board of Supervisors pass a resolution requesting receivership of the MCSO as soon as possible if Gov. Brewer does not act. This travesty has continued long enough. If Brewer or the Board of Supervisors will not act, then the DOJ will place the MCSO into federal receivership after months of litigation and the MCSO will be controlled from Washington, not locally from Arizona.

The United States vs. Criminals with Badges

When an angry white male called Arizona s Maricopa County Sheriff s Office (MCSO) complaining about Spanish being spoken at a McDonald s, MCSO organized 50 deputies (with flak jackets and M-16 rifles) and raided the McDonald s looking for illegal alien Mexican hamburger flippers.

Result: One or two or three illegal workers from Mexico and maybe a legal resident or citizen or two, all to be held in Maricopa County Sheriff Joe Arpaio s infamous desert tent jail where the inmates are fed a bologna sandwich a day. The raid cost thousands of dollars.

Unusual..?

No, this is a normal, regular day in Phoenix and surrounding Maricopa County where 78-year-old Sheriff Joe Arpaio reigns supreme. Whenever any elected politician has questioned Arpaio s tactics or his budget or the millions of dollars Arpaio disappeared from the jail account, he has ordered corruption investigations into their offices and personal lives.

These investigations have been declared bogus by the courts and Arpaio’s allies in the County attorney s office have not only been reprimanded by the courts but disbarment and criminal charges are pending.

In addition to the missing millions of dollars from the jail account and phony investigations designed to intimidate elected officials, there are also illegal campaign contributions handled by his top administrators that violated state laws.

The guilty officers were fired by a reluctant Arpaio only after a neighboring sheriff s department (Pinal County) publicly announced its investigation s findings.
Now enters the federal government.

The Department of Justice (DOJ) and the Homeland Security Department (HSD) have stripped MCSO of its federal privileges of assisting federal officers on immigration matters and stripped the County from the Secure Communities Act which means money and data base resources MCSO has been using will no longer be available.

In a letter to the county and in a press conference, the Department of Justice announced that after a three year investigation, Sheriff Arpaio and his deputies are guilty of hundreds if not thousands of civil rights violations and illegal racial profiling. It is also public knowledge that while Arpaio s deputies raid local McDonalds, they have not served 40,000 felony warrants outstanding in the county and have bungled hundreds of sex crime investigations.

In the DOJ letter to Maricopa County elected officials: If MCSO is not interested or if we deem that MCSO is not engaged in good-faith efforts to achieve compliance by voluntary means, we are prepared to file a civil action to compel compliance. In the actual report compiled of the investigation, there is a review of the constitutional abuses rampant in Maricopa County including an analysis by a leading expert on measuring racial profiling who examined MCSO traffic stops and found that (Arizona Republic):

Latino drivers were between four to nine times more likely to be stopped than similarly situated non-Latino drivers. Overall, the expert concluded that this case involves the most egregious racial profiling in the United States that he has ever personally seen in the course of his work, observed in litigation, or reviewed in professional literature. The most egregious racial profiling in the United States he has ever personally seen.

This, where an Arizona law SB 1070 requires all state and local employees, including meter maids, building inspectors and bus drivers, to use the exact same illegal methods to enforce the law.

Alleged Civil Rights violations in the report:

  • One-fifth of all the immigration-sweep traffic stops (20%) violated Fourth Amendment protections against unreasonable search and seizures.
  • Arpaio’s anti-immigration squads responded repeatedly with enforcement patrols to complaints about people with “dark skin” or Spanish speakers.
  • Jail guards punished Spanish-speaking inmates for failing to understand their commands in English, putting them in solitary confinement as punishment.
  • Jail guards refused to accept grievance forms and “tank orders,” which allow inmates to request basic daily services, which were written in Spanish.
  • Guards pressured (forced?) Latino inmates to sign voluntary deportation forms.

Arpaio’s office retaliated against its critics by subjecting them to “retaliatory detentions and arrests without cause, unfounded civil lawsuits, and other baseless complaints.”

Two specific examples:
A legal U.S. resident who allegedly failed to use his turn signal was made to sit on a curb for 15 minutes, then arrested and jailed for 13 days on a bogus charge that was dismissed in court.

A legal U.S. resident and his U.S. citizen son invited deputies into their home during a raid on a suspect drop-house next door. The deputies proceeded to search the home without consent or a warrant, handcuffed the man and his son, then, had them sit on the sidewalk with the people being busted from the neighboring house. They were detained for an hour before being released without any citation The investigation also found that the Sheriff’s Office permitted the specialized units to engage in unconstitutional behavior.

Arizona Republic: Arpaio and (his) aides expressed particular anger at how the Justice Department, which flew in a contingent of officials from Washington D.C., chose to trumpet its damning findings in “a dog and pony” fashion with a press conference. “Don’t come here and use me as a whipping post for a national, international problem,” the Sheriff said, alluding to the issue of illegal immigration. One of his aides called the whole thing a witch hunt. It appears that there Sheriff Arpaio and many of his deputies should be and might be in his famous desert tent city jail eating bologna sandwiches. A federal criminal investigation aside from this civil investigation is proceeding.

Joe Arpaio and Ron Paul – Birds of the Same Feather?

Joe Arpaio and Ron Paul have something in common. Neither seems to remember some ugly racist things written in their own publications.

Ron Paul claims he hadn’t written, read, or know who authored over a decade of newsletters with extremely racist and homophobic content that went out under his own name, though he owned the newsletters, promoted them, and received millions in newsletter subscriptions. You can find 50 scans of actual Ron Paul newsletters with racist or homophobic remarks here. Ron Paul now admits writing some of his newsletters, but now Ron Paul claimss there were only 8-10 sentences of “bad stuff”. Strangely he was never aware of those sections that showed such bigotry.

Now it turns out Joe Arpaio has severe selective amnesia too, especially when it comes to embarrassing bigotry published in his own name. Ever read “Joe’s Law: America’s Toughest Sheriff Takes on Illegal Immigration, Drugs and Everything Else That Threatens America“? If you haven’t read Joe’s book you are not alone! Joe Arpaio admitted under oath he hadn’t read his own book!

ARPAIO: Once again, I’m going to say my co-author did a lot of research and many parts of the book was attributed to him…this is something injected by the co-author and I’m not familiar with that whole situation.
