Here’s What Could Happen If DREAMers Lose DACA

District Judge Reed O’Connor, a federal judge in Texas — was appointed by former President George W. Bush in 2007.  If the Texas Judge blocks the DACA process, there will be a Mexican-American / Latin backlash like never before affecting the 2016 Presidential election Jeb Bush may want to run for.  It will also negatively impact the Republican Party as the fastest growing demographic via Mexican-Americans continue to increase.   There are approximately 500,000 new eligible American voters of Latin descent every year.

Just in from ABC / UNIVISION with regard to the DACA case we are all watching very closely since an anti-DACA lawsuit has been filed.  Earlier last week, the Texas federal judge indicated he was likely to “block Obama’s DACA” process:

In August 2012, the Obama administration started a program that allowed young undocumented immigrants to legally live and work in the U.S. on a temporary basis.

So far, more than 488,000 people have applied, and 268,361 have been granted a deportation reprieve under the program, called Deferred Action for Childhood Arrivals (DACA).

One of the biggest worries of applicants, however, is what might happen if the program ended. They might find out relatively soon.

A lawsuit challening the legality of that program appears to be gaining traction.

The suit was filed by several parties, including Chris Crane, a union leader for federal immigration agents. It makes the case that the U.S. Department of Homeland Security (DHS) is breaking the law by choosing not to deport undocumented immigrants it deems a low priority. By low priority, we’re talking about undocumented young people and immigrants with a clean criminal record and an established presence in the U.S.

The agents are being represented by Kansas Secretary of State Kris Kobach, who has helped draft state-level laws targeting undocumented immigrants, like Arizona’s SB 1070.

The case is still in its early stages, so figuring out how the judge will rule means a little bit of guesswork. Educated guesswork, but still not certain.

Kobach says he’s hopeful that the court will rule in his favor. But what that means for DREAMers all depends on which parts of the case the judge upholds, if any.

As Kobach sees it, certain aspects of the case could void DACA, and potentially lead to the deportation of undocumented immigrants participating in the program.

“I would hope that the law would be followed, and the law states very clearly that most of the individuals that are covered by DACA are to be placed in removal proceedings,” he told ABC/Univision.

But David Leopold, general counsel for the American Immigration Lawyers Association, sees things much differently. He doesn’t expect the program to stop.

First of all, Leopold has doubts that the lawsuit will be victorious. An order released earlier this week favored the plaintiff. But the judge, who presides over a federal district court in Texas, is still considering whether he has jurisdiction over the matter.

Even if the challenge is successful, Leopold thinks it will only mean some extra red tape for the people in the program and DHS.

A court order issued by the judge last week focuses on a particular aspect of the immigration process — when an immigration agent determines that someone is in the country without authorization.

The focus on that one particular aspect shows that the judge considers that part of the case to have merit, but perhaps not the other parts of the case, Leopold said.

If that scenario plays out — with the judge ruling favorably on this one aspect — it won’t be hard for DHS to find another way to administer DACA, Leopold said.

The department could just decide to give someone deferred action later in the immigration process. Yes, the ruling would force agents to detain someone they believed to be in the country illegally. But later stages of the process could be altered to keep DACA alive.

People in the program would likely have to go sign some papers, be placed in the custody of immigration authorities briefly — possibly minutes or hours, not days — but not have to appear before a judge, Leopold said.

The change wouldn’t take effect right away, either. The government could ask for a delay in making the change, and could file an appeal. We’re still in the early stages of the case. FULL STORY HERE.

I am seeing a definite pattern of Latinos having to preserve their property rights across the United States.  This time it is happening in our neighboring State of New Mexico, too:

Spanish land grant fight putting hundreds in limbo

ARROYO HONDO, N.M. (AP) — Fernando Martinez’s family has lived on the Arroyo Hondo Land Grant for more than two centuries, passing property from generation to generation in the popular area near Taos.

For the past couple of years, though, it has become impossible for Martinez or hundreds of others with homes in the mountainous northern New Mexico enclave to do much of anything with their properties.

The 31-square-mile land grant, parceled out by the Spanish monarchy in the early 19th century to encourage settlement of the then-remote region, is at the heart of a bitter legal tug-of-war that has thwarted property owners’ efforts to sell or refinance their homes, or even buy insurance policies, while pitting frustrated neighbors against each other.

Martinez is among those who finds himself in the legal quagmire after a group of descendants of the original landowners claimed they are the rightful heirs to the land.

“It’s a mess,” said Martinez, 66, a retired miner who couldn’t obtain a title to house he wanted to purchase. “We can’t do anything. It’s like we’re stuck in time.”

The dispute began in 2010 after the Arroyo Hondo Land Grant Board filed a warranty deed with the Taos County Assessor’s office in an attempt to reclaim 20,000 acres of private land originally granted to Arroyo Hondo’s founding families. In the deed, the five-member board claimed that the Spanish land grant belonged to board members and heirs with blood ties to the originally Hispanic settlers, some of whom later became victims of white land speculators who were allowed to roam free after the U.S.-Mexican War.

“What you’re dealing with is colonial history and land grabs as a result of conquest,” said Santiago Juarez, the board’s attorney. “It’s not easily resolved.”

NumbersUSA using Texas Sen. Ted Cruz as a Tool though Cruz’s Family Benefited From Cuban Amnesty

On Monday, Sen. Ted Cruz told Sean Hannity: “I think that [a path to citizenship] is profoundly unfair …”

It looks like the Texas Senator (Cuban-American) Ted Cruz is the poster boy for Numbers USA.  According to the SPLC, Roy Beck, was head of the immigration-restriction group NumbersUSA.

SPLC states:

Beck leads an organization that has reached the heights of mainstream legitimacy, a position that helped NumbersUSA achieve dramatic policy successes, most especially in June 2007, when his followers flooded the Senate with more than a million faxes. (The onslaught helped doom comprehensive immigration reform that had bipartisan support and had been expected by many observers to pass.) He has long insisted that NumbersUSA has no “vision of a homogenous white America,” and his website decries all manner of “immigrant bashing” and racism.

But John Tanton has come to be an embarrassment. His longstanding connections to white nationalist ideologues, his flirtation with anti-Semitism, and his many racist statements about Latinos have become well known — and are a huge liability for Beck and his restrictionist program. Pressed, Beck claims he is not ashamed of his mentor. But Tanton’s name is nowhere on his website. John Tanton, it seems, is undermining Roy Beck’s respectability.

“It is amazing that Beck has attained the mainstream status he has, considering where he comes from,” concludes Henry Fernandez, a senior fellow at the progressive Center for American Progress, a think tank based in Washington, D.C. “His extremely close and decades-long relationship with Tanton should give pause to anyone who deals with NumbersUSA.”

Does this mean Cruz is against privileged amnesty Cuban immigrants receive via the Cuban Adjustment Act of 1966?

Is the Tea Party politician Cruz against Cuban immigrants receiving government benefit$ once their wet foot touches dry land since Tea Party people claim to be in support of doing away with tax payer funded government entitlement$?

What about the Cuban immigrant dry foot that touches dry land?  Is this why we are seeing a spike with regard to Cuban immigrants coming through Mexico?

That said, let it be understood the Texas Senator is on the record for ending his speeches with a story about how his father fled Cuban oppression.  According to the Dallas News, “his father departed for the U.S. in 1957, more than a year before Fidel Castro came to power.”

Cruz stated:

“My dad fled Cuba. He was imprisoned and tortured as a teenager, and came to Austin penniless, seeking freedom. The reason I’m running is simple. He fled oppression once. And you have my word that I’ll fight every day to protect freedom here, so that none of us have to flee oppression a second time.”

Penniless?

I thought his dad had money sowed into his underwear?  According to the inflation calculator, $100.00 back then is equivalent to $826.21 today.  That is a whole helluva lot more money than the dying immigrant crossing the desert comes here with.  Many immigrants crossing the desert die of dehydration.

According to FOX NEWS:

Cruz’s father Rafael is a pastor outside Dallas. He fought with Fidel Castro’s rebels in Cuba before Castro took power and eventually embraced communism, and the elder Cruz fled to the U.S. with nothing but $100 sowed into his underwear.

If Cruz believes in the idea of fleeing oppression and the corrupt Fidel Castro — doesn’t he know that Mexico’s corrupt score is worse than Cuba’s according to the Global Coalition Against Corruption?

I know a bunch of immigrants who came here  without a single dime to their name, and they come here to avoid the oppressive drug cartels.   They come here not seeking government entitlements and are not afraid of working in the hot agricultural fields  for a hard earned day’s pay.  Most immigrants do not receive a year’s worth of government entitlement$ the Cuban immigrants receive.

According to the Dallas News:

Rafael Cruz legally went to Texas on a student visa issued by the Batista regime, Ted Cruz said.Ted Cruz, who opposes amnesty for illegal immigrants, said at no time was his father an illegal immigrant. He said his father, who graduated from the University of Texas in 1961, eventually became a permanent legal resident.

What Cruz won’t elaborate is how his daddy eventually became a permanent legal resident.

Did his father eventually benefit from the Republican Ronald Reagan amnesty?

More importantly, it appears Cruz had family members who benefited from the privileged Cuban Amnesty via the Cuban Adjustment Act (CAA).  Ted Cruz’s dad had a sister and parents who made it to the U.S. during the 1960s and coincidentally the CAA is a United States federal law enacted on November 2, 1966. Passed by the 89th United States Congress and signed into law by President Lyndon Johnson, the law applies to any native or citizen of Cuba who has been inspected and admitted or paroled into the United States after January 1, 1959 and has been physically present for at least one year; and is admissible to the United States as a permanent resident.

Dallas News writes:

Rafael Cruz’ younger sister and their parents eventually made it to the U.S. during the 1960s, Ted Cruz said.

Cuban-Republicans like Ted Cruz do their best to create that wedge with the Mexican-American population.  NumbersUSA and the John Tanton network know this.  NumbersUSA also knows that Mexican-Americans account for almost 70% of the “Latino” population while Cuban-Americans only account for 3%.

Ted Cruz of all people ought to know (since Texas shares the longest border length with Mexico) how many Cuban immigrants come to the United States thru Mexico. And now that his grandparents and family members are here in our Nation … it appears he wants to ensure the door is shut behind them preventing others who come here to achieve the American DREAM.

There is a stir in south Texas that is waking up the Mexican-American giant — and I can’t wait to hear Representative Joaquin Castro make Cruz look like a hypocrite.    Castro understands and has empathy for Mexican-American families in Texas while Cruz  does not.  How could Cruz feel and understand Mexican-Americans angst?  He’s not of Mexican descent, and I predict he will not last in Texas since he is not in support of legal immigration reform in a state that is a home to millions of  Mexican-American Texas citizens.

Unfortunately for Cruz … he is unaware of the team he sides with via NumbersUSA and the John Tanton network who have done everything in their power to chip away at the Treaty of Guadalupe Hidalgo. It is imperative for the United States to maintain a healthy relationship with our soil neighbors as the world wars will eventually come to a head.

It is my understanding Ted Cruz’s father is a pastor, and it is unfortunate his dad didn’t instruct his son to “love they neighbor.”  Mexico is our neighbor and we ought learn the lesson of World War I when Germany tried to advance through Mexico when they proposed an alliance with them in their  infamous Zimmermann Telegram.  Thankfully Mexico declined.

 

 

 

 

 

Can we afford Nevada Republican Dean Heller as a Senator? Shelley Berkley supports the DREAM Act.

Sen. Dean Heller (R), is locked in a tight race for reelection against Rep. Shelley Berkeley in Nevada, and now he is distancing himself from Mitt Romney

The question Latinos in Nevada have for Mr. Heller is whether or not he agrees with the GOP anti-immigrant platform that emulates Arizona’s harsh anti-immigrant policy.

Does Dean Heller support the DREAM Act?

Will Dean Heller sign off on a reasonable legal immigration reform bill?

I’m afraid Mr. Heller will not work towards legal immigration and the DREAM Act.  Below is an excellent video from his competitor, Shelley Berkley, who does support the DREAM Act.

DNC Keynote Speaker Tejano / Mexican-American Julian Castro trumps Cuban-American Sen. Marco Rubio

We hope to see former Texas Mayor Julian Castro help turn the State of Texas turn purple soon.  He is set to speak as keynote speaker for the DNC tonight at 10:00 pm eastern time or 7:00 pm Arizona time.

We need more rising stars like Castro to root out the Republican Congressman Lamar Smith extremists.  Someone like Lamar Smith should not hold power in Texas for much longer and he knows it.  Republicans are the modern day Dixiecrats and are so last generation. They no longer believe in the big tent, which is why we see the Democratic Party working harder for the Latino vote …  and for those of you critics who think Latinos do not want to get wooed — WE DO.

LATINOS HAVE BEEN WANTING BOTH PARTIES TO WORK HARDER FOR OUR LOVE AND THAT IS THE BOTTOM LINE.  It’s about freakin’ time, too!

According to WIKI:

Castro was born in San Antonio on September 16, 1974[2] to Maria “Rosie” Castro and Jessie Guzman.[3] He is the identical twin brother of politician Joaquín Castro.[2] His mother was a Chicano political activist who helped establish the chicano political party La Raza Unida.

So why does Mexican-American Julian Castro trump Cuban-American Sen. Marco Rubio?

Easy.  It’s a numbers game.

Almost 70% of the entire Hispanic Population pie consists of those who are of Mexican descent while Cubans consist of only 3% of the Hispanic population pie.

Get the picture?

Cuban Republicans like Sen. Marco Rubio and Ted Cruz are for Cuban amnesty while damning the Mexican, Irish, Indian immigrants.  In other words, the immigration issue doesn’t hurt them as much as it does us because they receive amnesty.  Cuban Republicans have squandered their Latino street credibility and in my view it is time for the dog to wag the tail instead of the other way around.

Mexican-American voters are the gold mine due to our sheer numbers and voting strength that will be off the hook as years go on.  Hallelujah to that!

Tequila Party 2nd Protest of Tea Party Arpaio at his Ascension Catholic Church

Phoenix, AZ — On 29 July 2012, the National Tequila Party Movement protested Sheriff Joe Arpaio at his own Ascension Catholic Church, but he did not show up to church on that day.  This past Sunday, Arpaio tweeted he went to Catholic mass.  Latinos are not aware of the Catholic Church condemning Arpaio’s anti-immigrant and culture of death he has brought to Arizona, but we will continue to appeal to moral authorities like Bishop Olmsted to help the Mexican-American community.  We believe Arpaio to be a type of devil as he has contributed to the hate and evil against the Mexican-American community.

The Tequila Party will be protesting Tea Party favorite Arpaio again at his Church this Sunday with an effort for fellow Catholic faithful members to convince Arpaio he is wrong for not taking a Catholic Christian compassionate view of immigrants.   More importantly, the corrupt Sheriff Joe Arpaio has been allowed to embrace the Culture of Death in his jail.  He has made jokes about the mysterious Mexican deaths in his prison, and indeed our people are dying in his jails.

The Tequila Party Movement will continue to protest Arpaio until we receive a breakthrough. The Tea Party cannot expect the Mexican-American population to turn a blind eye to the mysterious deaths that are occurring in Arpaio’s jail.  Mexican matriarchs have made an open plea to Bishop Olmsted to consider denying the Eucharist to Arpaio the same way the Catholic Church denies it to  pro-choice politicians.  If Bishop Olmsted cannot deny the Eucharist, we are asking him to consider publicly condemning the culture of death actions supported by Arpaio.

Desperate times call for desperate measures.  We are trying to prevent more unjustified deaths in the Maricopa County jail system.    Arpaio is responsible for terrorizing Latinos and immigrants in the State of Arizona.  How much more do our people have to suffer when many Latinos of Mexican descent are members of the Catholic Church?   Since there is an extreme partisanship nature in our government, will those who claim to be of moral authority help the people?

The reality is the Latino community views Arpaio as a type of devil.  We want Arpaio to know how he has become a destructive evil force in the State of Arizona, and we hope he will take heed to the instruction of the Catholic Church as it applies to the treatment of our neighbors and fellow mankind.

Latinas to boycott FOX News due to biased reporting on Sheriff Joe Arpaio Maricopa County race and minimizing independent voters

The National Tequila Party Movement (Latina-led counter movement to the Tea Party movement) is boycotting FOX News.  Once again FOX News is in the back pocket and openly supporting their poster child, Maricopa County Sheriff Joe Arpaio. In an article recently published on Foxnews.com, states:

FOX couldn’t have made their support of Arpaio any clearer.  By talking up a Democratic candidate for sheriff in a largely conservative county with a political party that isn’t even running a candidate for county attorney is highly suspicious and calculated.

FOX News knows full well Penzone doesn’t stand a chance against Arpaio and is welcoming him with open arms and all prior to his even going through the Democratic Party primary election on August 28, 2012.  Clearly FOX News appears to underestimate the 2nd largest Party in the State of Arizona via independent registered votersnd largest Party in the State of Arizona via independent registered voters.  This is why independent voters have surged, and Democratic registered voters dropped by approximately 52,000 according to the Arizona Republic (Arizona’s largest newspaper source).   Penzone, the newly converted and courted Democrat who comes complete with a Domestic Violence incident and record in his background, a lack of will to complete his college education and a TV star for Phoenix Police, would be just the candidate to promote on behalf of Joe. We certainly can’t believe the “Fair and Balanced” act would include welcoming such a man as Penzone into their fold.

FOX also continues their biased approach by seeking comments from and on behalf of two of the four candidates. FOX News knows as does every educated politico, that the Independent in this race has a significant opportunity to win the sheriffs race this November. It is also very unwise to dismiss the Democratic primary where two Democratic candidates, John Rowan and Penzone must face off to earn the spot on the November ballot.

Pearce fundraiser booted from 2 Mexican restaurants

Former Senate President Russell Pearce is scrambling to find a location for a fundraiser scheduled for this afternoon, as two different Phoenix Mexican restaurants told him today that he is not welcome.

Pearce did not immediately return a call. Constantin Querard, who is running Pearce’s campaign, did not know who was organizing the fundraiser. However, he said that he was surprised to hear that Oaxaca had said Pearce wasn’t welcome and disputed Aguayo’s claim that the restaurant didn’t know the event was for Pearce. …

If Pearce’s campaign finds a new location for the fundraiser, Garcia Blase said her group will contact the business and threaten to boycott and protest them.

“We’re just going to keep playing this Whac-a-Mole game,” she said.

 

QUESTION:  How can Constantin Querard NOT know who is organizing the fundraiser if HE is running the entire Pearce campaign?

Seems to me that Querard does not know how to run a tight ship.   Even I know who is going around trying to re-schedule the Pearce venue and the name being used is “Jessie”.   Jessie is not giving her last name for some reason, nor is she telling these restaurants what the event is for.

Latinos/Chicanos/Hispanos will no longer stand for allowing politicians to make a mockery of Mexicans.  Enough is enough.  Russell Pearce and his bosom buddy via Joe Arpaio seem to embrace a culture of death.  This week we heard of another Latino inmate who died in Arpaio’s prison.  We are desperate to stop the hate against Latinos.

On another note, Pearce and his cronies are motivating Latinos to do more.  To become better organized as political activists.  If SB 1070 passes the Supreme Court — this will light the much needed fire under our bottoms to vote during the 2012 Presidential elections.

 

 

 

UPDATE: Telephone conversation with Gary Johnson, CEO of Macayo’s and follow up email

I just now finished a telephone conversation with Gary Johnson the CEO of Macayo’s Restaurant Regarding Russell Pearce.  He was not aware that there was a Russell Pearce fundraiser at his restaurant until the National Tequila Party brought the controversial event to his attention.

Gary also did not know that Russell Pearce has referred to Mexican immigrants and immigrants as “wetbacks. ” I sent Gary links with regard to Pearce saying he welcomed Operation Wetback to the State of Arizona and where Pearce didn’t think “wetback” was a demeaning term.

Gary will be calling me back in about an hour to let me know what his decision will be.  For now, the Tequila Party Movement (counter movement to Tea Party extremists) and members will protest and boycott Macayo’s for hosting a Russell Pearce event until further notice.

The Chicano Movement via the next generation is alive and well via the Tequila Party.  Tequila is stronger than tea.

In 2006 and in 2010, the ousted Senator Russell Pearce is on the record for welcoming operation wetback.  In fact, at a Republican meeting, I communicated to Republicans and to Russell Pearce to stop using that derogatory term in 2010 shortly after Jan Brewer signed the SB 1070 law which has harmed Latino families and Arizona businesses.  As you may already know, the ousted Senator Russell Pearce is the main sponsor to SB 1070, in fact, his Arizona law sparked similar laws across the country that contributed to anti-Latino sentiment across our Nation.  Now, we believe Russell Pearce wants to make a mockery out of Latinos now by hosting his fundraising event at your Mexican restaurant.  I know Pearce can host his fundraiser where ever he wants to, but Mexican-Americans, Chicanos and Latinos can also invoke our freedom of expression to protest and boycott companies who allow bigots to have events at their companies and restaurants.

There is a time where we have to stand up and say, “bigotry is not right and I don’t want any part of it.”

Is it really worth it for Macayo’s to host a fundraising event of a known extremist knowing the backlash and consequences this will bring for future years?

Russell Pearce has had the endorsement and backing of anti-Latino Sheriff Joe Arpaio, and both continue to make a mockery out of Latinos today.  In fact, another Latino inmate died mysteriously in Sheriff Joe Arpaio’s prison and Latinos can no longer ignore the horrible atrocities against our people.  I recall Sheriff Joe Arpaio making jokes about the mysterious Mexican deaths at his prisons at a GOP meeting when Arpaio was criticizing John McCain in 2008.   Enough is enough. Our people are hurting enough as it is without the continued mockery being made against Mexicans and immigrants.

We are rising up, and we will let our voice be heard.
