Tucson GLBT Chamber of Commerce Opposes SB1045 (as amended)
The Tucson GLBT Chamber of Commerce, the business voice of Tucson’s Gay, Lesbian, Bisexual, Transgender and Allied community decries SB 1045 as amended, which encourages gender-based discrimination and protects publicly licensed organizations from prosecution for denying citizens their rightful access to privacy areas. We call upon the Arizona legislature to defeat this inappropriate, discriminatory and unenforceable proposal.
SB 1045 is completely unnecessary. It neither addresses nor solves any existing problems and would serve only to pile on ridicule of our state and its leaders. It is a shocking violation of individual civil rights. Private spaces always have been and always will be private spaces. Inappropriate behavior in private spaces always has been and will continue to be forbidden. Furthermore, we can find no recorded instance of any transgender citizen acting inappropriately in a common restroom. To the contrary, Tucson in fact has had a non-discrimination ordinance in effect for 14 years and has never had a “bathroom problem.”
As written, this bill blatantly victimizes transgender people, and encourages intolerant people to discriminate arbitrarily against anyone who, in their proximate judgment, doesn’t satisfy their opinion of what appropriate gender expression should be. The mind boggles at the thought of how any proprietor might try to ‘prove’ that an individual’s gender is not what it seems. Such discrimination has been contrary to national policy for generations and should not be encouraged in 2013. The potential for litigation and other monetary penalties alone should eliminate this proposal from serious consideration.
Arizona doesn’t need more reasons for businesses to reject our state as a friendly and suitable place to do business. We urge the legislature to reject this and other non-essential and discriminatory legislative initiatives in the interest of promoting economic growth and a welcoming environment in which to live and do business.
