I am State Senator Russell Pearce, the author of SB1070, signed by Governor Jan Brewer.  Maybe Rep. Kyrsten Sinema ought to read the Constitution, case law or even just the bill itself before she cites incorrect information.  Fear mongering and misinformation are opponents’ only tool against this common sense legislation.

Illegal is not a race, it is a crime.  SB1070 simply codifies federal law into state law, removes excuses and concerns about states’ inherent authority to enforce these laws and removes all illegal “sanctuary” policies.

When do we stand up for Americans and the rule of law? If not now, when?  We are a nation of laws, a Constitutional Republic.

Arizona did not make illegal, illegal.  Illegal was already illegal.  It is a crime to enter or remain in the U.S. in violation of federal law.  States have had inherent authority to enforce immigration laws and have failed or refused to do so.  Sanctuary policies are illegal under federal law (8 USC 1644 & 1373) yet we have them all over the United States.

Paul Kantner of the 1960s rock band Jefferson Airplane once remarked, “San Francisco is 49 square miles surrounded by reality.”  When I first heard that San Francisco was planning to boycott Arizona over the SB 1070 legislation that I introduced, this description seemed fitting.

However, when neighboring Oakland’s city council voted 7-0 to boycott Arizona last Tuesday, and President Pro Tem of the California State Senate Derrell Steinberg announced a campaign in the legislature to boycott us, it became clear that San Francisco is merely ahead of the California crazy curve.

Why did I propose SB 1070?  I saw the enormous fiscal and social costs that illegal immigration was imposing on my state.  I saw Americans out of work, hospitals and schools overflowing, and budgets strained.  Most disturbingly, I saw my fellow citizens victimized by illegal alien criminals.  The murder of Robert Krentz—whose family had been ranching in Arizona since 1907—by illegal alien drug dealers was the final straw for many Arizonans.  There are dozens and dozens of other citizens of our state who have been murdered by illegal aliens.  Currently, 95 illegal aliens are in Maricopa County jail for murder.

Most of the hysterical critics of the bill do not even know what is in it.  All SB 1070 does is allow Arizona law enforcement officials to detain illegal aliens under state law.  The law does not allow police to stop suspected illegal aliens unless they have already come across them through normal “lawful conduct” such as a traffic stop, and explicitly prohibits racial profiling.

Aside from the unfounded accusation of racial profiling, the chief complaint about the bill is that it infringes on federal jurisdiction by enforcing laws.  However, there is a long legal precedent going back to 1976 that allows states to pass legislation to discourage illegal immigration so long as it does not conflict with federal law.  SB 1070 was specifically designed to mirror federal immigration law to avoid such a conflict.

For all their newfound respect for the authority of federal immigration law, the open borders advocates who oppose SB 1070 have no problems with “sanctuary cities” such as San Francisco that explicitly obstruct federal immigration authorities to protect illegal aliens.  In 2008, San Francisco began a campaign to encourage illegal aliens to take advantage of the city’s public services.

Mayor Gavin Newsom stated, “We have worked with the Board of Supervisors, Department of Public Health, labor and immigrant rights groups to create a city government-wide public awareness campaign so that immigrants know the city won’t target them for using city services.”

The results were tragic. A few months after the campaign, Edwin Ramos, an illegal alien and member of the MS 13 gang, murdered San Francisco resident Tony Bologna and his two sons who he mistook for rival gang members.  Ramos had a lengthy criminal record including a felony assault on a pregnant woman.  He was arrested on gang and weapons charges and promptly released just three months before the murder.  Not once did San Francisco report him to immigration authorities.

One month after the murder of Bologna, illegal alien Alexander Izaguirre stole Amanda Keifer’s purse and then intentionally ran her over with an SUV, laughing as she hit the pavement and fractured her skull.   Four months earlier, Alexander Izaguirre had been arrested for felony dealing of crack cocaine.  Not only did San Francisco refuse to turn him over to immigration authorities, city officials expunged his record and helped get him a job, which is criminal in and of itself.

Keifer asked the obvious question, “If they’ve committed crimes and they’re not citizens, then why are they here?  Why haven’t they been deported?”
The answer is that politicians like Gavin Newsom put the interests of illegal aliens before the safety of American citizens, not unlike Phoenix Mayor Phil Gordon and others.

Our law is already working.  One can just scan the newspapers and see dozens of headlines like “Illegal Immigrants Leaving Arizona Over New Law: Tough, Controversial New Legislation Scares Many in Underground Workforce Out of State,”

In contrast, American citizens are leaving California.  For the last four years, more Americans have left the state than have moved in.

In criticizing the SB 1070, President Barack Obama said, “Our failure to act responsibly at the federal level will only open the door to irresponsibility by others.”  There is nothing irresponsible about enforcing our law, but President Obama is right in that this is only necessary because the federal government does not do its job.

The solution is not “comprehensive immigration reform,” a euphemism for amnesty.  This will only encourage more illegal immigration.  Making illegal aliens legal does nothing to change the social and fiscal costs they impose on Arizona or the nation as a whole.  In fact, the Heritage Foundation’s research puts the cost of amnesty at over $2.5 trillion.

The federal government simply needs to enforce its immigration laws by cracking down on employers of illegal aliens, securing our borders, and deporting illegal alien criminals.  Attrition by enforcement.

If states understand states’ rights and our Constitutional duty and responsibility to our citizens this legislation in Arizona will be a model for states across the nation and the federal government and it will end illegal immigration to America, but President Obama is looking toward San Francisco instead.

    Arizona certainly has become a “model” for States across the nation, replacing Alabama and Mississippi as the kind of State that parents threaten their children with for not eating their vegetables.
    There are conflicting views of reality here – one held by Pearce, the other held by opponents of 1070.
    In Pearce’s “reality” 1070 will result in a more peaceful State and will attract economic growth and investment and help with our budget woes.
    Opponents claim that the “model” will be a state of racial profiling, will scare away investment, tourism, cause even greater harm to our beleaguered education institutions, and render the State the “model” laughingstock of the Nation.
    The thing about reality is that only one view can be true, the other a delusion.
    We will discover which view is reality, and which delusion, soon enough.

    We should treat immigrants like Mexico does:

    At present, Article 67 of Mexico’s Population Law says, “Authorities, whether federal, state or municipal … are required to demand that foreigners prove their legal presence in the country, before attending to any issues.”

    That would simplify things.

    Jim crow laws were not about a race either according to white southerns, it was about paying for a right to vote with a voting tax.

      Black Americans in the US south were not illegally in the country. They were American citizens being denied rights they were entitled to under the Constitution.
      The people this bill applies to are already in violation of US law. Being here is not a right they are guaranteed by any US law.
      The cost billions in social costs, depress wages, and take jobs from low skilled Americans.
      I’m a Latina immigrant and I did it legally. It’s not hard to do. You jsut have to be qualified.

    Thank you Pearce and you are right on!  This is an excellent article.  If you out there are claiming yourself to be an American citizen who cares about their country….how could you not see the wisdom of this law SB1070.  California is a disgrace and they could easily step up to the plate if they had any guts.  I hope more of the drug dealers and illegal immigrants gravitate over to California because they won’t enforce a similar law, they will make it easy on the illegal immigrants and you deserve them all.  California, you embarrass me!

    Notice how many of them are going home because of the lack of jobs? After my relatives got here in 1748 and 1900 they didnt leave because of the Depression or World Wars.     This is what it will cost Arizona

    Lets say that the law comes into effect and you incarcerate one fifth of the undocumented 500,000 Cat and Mouse immigration workers.
    If you incarcerate just 100,000 in one year you would have to build 50 new state prisons with a 2000 max capacity which is a huge operation. At a price tag of 35,000 an inmate you would have to pay 35 billion dollars a year, remember this is a state crime and the feds would be out of the picture. You already have a million dollar deficit. No tell me where is Arizona going to come up with 35 billion dollars? Smart State Government.

    SB 1070 is a smokescreen designed to give cover to Sen Pearce for not confronting the problem of illegal immigration.  Instead, this allows him to scapegoat hispanics and provide a rallying cry to get reelected.

    To solve illegal immigration,  employers must be given disincentives such as heavy fines and jail time for hiring those without proper documentation.

    These laws already exist.  They will never be aggressively enforced because big businesses need cheap labor in order to enhance profits.  Without the cheap labor, incumbent lawmakers would not receive the donations necessary to keep them in office.

    That’s why we get grandstanding instead of thoughtful, civil discourse eminating from our state representatives.

      Big business and lots of smaller ones do not need cheap labor. They want cheap labor so they can make excess profits while the US taxpayers pick up the tab for the social costs of his illegal workers. Businesses are not guaranteed labor they can afford. The hiring of illegals makes it impossible for honest businesses to compete, creating an less than level playing field.
      Labor is an input to production (as economists would say). Are businesses allowed to use other illegal inputs to production? Suppose McDonalds decided that they could make more money by using illegally imported, uninspected beef for their burgers. Would anyone eat there? Would the health department allow them to stay open?
      The reason that Latinos feel they are the target is because they are 90% of the problem and it’s higher that that in AZ. Nationwide only 10% of illegals are not Latino.

    I want to say I will be going to the Colorado river in Yuma Arizona for my water-ski vacation instead of the the local lakes. And I am going to spend as much money in Arizona as I can In support of Americans living there. The lakes and parks in So cal are infested with illegals on every holiday. Trash everywhere they go. And the Mayor of L.A. Has a law if police ask for your citizenship the policeman will be fired. L.A sucks and If I was a tourist I would avoid L.A. with a 75 mile radius. MS 13 Runs all the streets.     Is there anyplace else other than AZ on the entire planet that a guy like Russell Pearce could get elected?  I doubt it.  Is there anyplace (with the possible exception of Burma) that a law like SB 1070 could pass the legislature?  I doubt this also.  All this makes me think that Arizona is the island of unreality.

    Arizona stands up & does something about all the ILLEGAL aliens pouring across the border, & people compare it to Nazism,call it profiling,yada,yada? What is wrong with showing your ID? Voting,banking,cashing a check, to name only a few,require ID of some sort. If you have a legitimate one, why does it matter if you’re asked to show it? Got something to hide? You think our laws are strict, ask the people who had been held indefinitely by Iran for crossing the territory. What about China,where incursions get you in prison for life? North Korea? No where in the world are people allowed to waltz into a country & given citizenship status & don’t have to become citizens.
    Arizona, good on you. You stepped in to the breech when the Feddies didn’t; they’re too anxious for all those illegals to vote for the status quo. I only hope Texas follows suit with Arizona.

      I’m proud to be a legal Latina immigrant who did thinks by the book and became a citizen. The Latinos who oppose this either can’t read or don’t want to miss an opportunity to play the race card.
      Compared to the requirements to carry and produce ID or other documents in Latin America this bill is not very intrusive. I look Latina and if I do something to get stopped by the police, I’d be happy to show who I am and my status. It’s simply a minor inconvenience which preserves the US as  nation of laws. Anyone here illegally who feels targeted can solve the problem by going home. Anyone else who feels targeted can put the blame squarely where it lies – on the Latinos who come here illegally and make us all suspect.

I live in San Francisco and am a victim of this progressive wetdream.No other nation stands for this happy horsepucky of open borders and neither should we.     I have 4 people in my family just waiting until Arizona cleans up it’s illegal immigration problem, then we will move BACK and work, pay taxes and contribute to the state. I’m sure we arent the only ones either. We also have friends, family, and neighbors who tell us that they would love to come to Arizona for a visit (tourism) and stay with us for a little bit when Arizona cleans up it’s illegal immigration problem!When are the opponents to 1070 going to see that U.S. citizens in other states like Indiana are SICK of the illegals that are invading Arizona and purposely stay away from there?!?!     I think we can all agree that the problem is at the border, if you are so worried about the safety of Arizona you should focus on securing our borders. Stop wasting out time with this law that will only open the door for racial profiling. If illegal is not a race why did Governor Brewer say that she will wait for AZPOST to make a description of what an illegal imigrant looks like. Asking a person who seems like they may be here illegally based on “reasonable suspicion” for proof of citizenship will not make anyone safer. Wake up and face reality. The real problem is not people entering illegally, the problem is the companies that employ them. Yes in the bill is does say that it is illegal for companies to employ illegal immigrants but I feel that your main focus will be on the citizens. What are you guys doing about the great demand for drugs in the US? The high demand is what is bringing the drug cartels into the Arizona. If Americans were not addicted to drugs we would not have this problem. Considering that you guys in the Capitol could not even balance the budget, I highly doubt that you will ever be able to secure our borders. This new unfortunate law only proves me right.

    Illegal immigrants swarm into our country and quickly jump on the welfare rolls. They cost hard-working U.S. citizens billions and billions of dollars in taxes because of this subsidy.
    That’s a familiar, easy charge leveled by critics of illegal immigration. But is it fact or fiction?
    It’s actually a myth, according to the Congressional Research Service, the investigative arm of Congress. This point is highlighted as one of the “top five immigration myths of the campaign season,” a list put out by the American Immigration Lawyers Association.
    Here’s their look at welfare:

    MYTH #3: The nation spends billions of dollars on welfare for undocumented immigrants.
    FACTS: To the contrary, undocumented immigrants are not eligible to receive any “welfare” benefits and even legal immigrants are severely restricted in the benefits they can receive.
    As the Congressional Research Service points out in a 2007 report, undocumented immigrants, who comprise nearly one-third of all immigrants in the country, are not eligible to receive public “welfare” benefits — ever.
    Legal permanent residents (LPRs) must pay into the Social Security and Medicare systems for approximately 10 years
    before they are eligible to receive benefits when they retire. In most cases, LPRs can not receive SSI, which is available only to U.S. citizens, and are not eligible for means-tested public benefits until 5 years after receiving their green cards.
    A 2007 analysis of welfare data by researchers at the Urban Institute reveals that less than 1 percent of households headed by undocumented immigrants receive cash assistance for needy families, compared to 5 percent of households headed by native-born U.S. citizens.
    A 2007 analysis of U.S. Census data by the Center on Budget and Policy Priorities makes clear that it is the U.S.-born, U.S.-citizen children of undocumented immigrants who are eligible for programs such as Medicaid and the State Children’s Health Insurance Program
    (SCHIP). The analysis found that, between 1995 and 2005, the share of low-income, non- citizen immigrant children (either undocumented or legally present) who received Medicaid or SCHIP dropped from 36 percent to 30 percent

    I sit here clapping my hands. What a great job you and your followers have done for the state of Arizona. You and the rest of are so called leaders have diverted the focus from the state budget crises (which you have done nothing) to immigration.  With your pledges to Grover Norquist and Americans for Tax Reform, you just played the shell game and had local governments raise taxes. Instead of leading this state you passed that decision on to the voters just so you could keep your pledge. Instead of leading you spent your time on sparklers, birther bills and other useless bills. You have done nothing to solve the state budget. If immigration was you priority why is this bill not funded? Who is going to pay for the training of all the police agencies that are already under tight budget constants?

    I have 4 people in my family just waiting until Arizona cleans up it’s illegal immigration problem, then we will move BACK and work, pay taxes and contribute to the state.
    That’s great news – I’m looking for some home buyers. Trying to get out of the State is a real bitch when you consider selling your home at a loss.
