Kill SB 1070 by vigorously enforcing it

“President Ulysses S. Grant once said “the best way to get rid of a bad law is to enforce it.”

If the federal government’s lawsuit against Arizona fails to block SB 1070 going into effect July 29, maybe Grant had the right idea.

There are 3 basic issues with SB 1070:

–the state invading federal jurisdiction on immigration

–the state legislature attempting to prioritize how local governments use limited law enforcement resources

–racial profiling.

So…maybe vigorously enforcing SB 1070 is the real path to waking Arizona voters up to the fact that SB 1070 is really not the answer to the illegal immigration issue.

Here’s the potential scenario:

–local cops start rounding up lot and lots of illegal aliens and turning them over to the Border Patrol. Those of us who live near the border and/or who have been involved in local law enforcement down here know that often the Border Patrol does not show up to take custody of undocumented aliens that are caught locally. The feds don’t have the detention facilities or the transport facilities to handle a major increase in captured illegals. Flood the Border Patrol with undocumented workers.

–since the Border Patrol will not likely take custody of hundreds and maybe even thousands of undocumented workers rounded up by local police, there is no choice but to fill out our state’s jails with illegal aliens. At some point we’ll have to start releasing murderers and rapists to make room for the hundreds and maybe thousands of illegals that are rounded up. Maybe temporary detention camps will have to be set up. Taxpayers ought to be really happy their law enforcement resources have been hijacked by Sheriff Joe Arpaio and Governor Jan Brewer and State Senator Russell Pearce.

–to avoid racial profiling, given that maybe 75% of the state’s population is Anglo, rigorous attention must be paid to stopping 3 Anglos for every Hispanic to enforce SB 1070. Hassle enough Anglos with SB 1070 and they might realize the danger of this law.

If the federal effort to enjoin SB 1070 going into effect fails, then lets vigorously enforce SB 1070 and see what happens.

    Here is another scenario!  The people that are oppose to this bill set up the cops.  Cop stops someone that is opposed to this bill and they cry racial profiling even if it never happened.

      I’m sure that this will happen in some form.  If the legal challenges fail, we are likely to see other attempts to kill this law.  Civil disobedience has already been discussed.  The law does include a provision for citizens to sue the police for failure to enforce, so this could be another approach to challenging this law. 

      Whatever it takes, this law will not stand.

        Heck, it happens now…and not with just immigration issues.  Any time a person belonging to a minority group is stopped by a law enforcement official for any reason, there’s the potential to hear the cry “RACIAL PROFILING”.  I watched a “Cops”-type program some time back where a young black male was pulled over by a white police officer.  Immediately, the individual starts complaining that he was pulled over due to “racial profiling”.  The problem was, his vehicle’s windows were tinted with that black tint film you commonly see on limos…the officer couldn’t even see inside the vehicle.  So yeah, that was so obviously racial profiling…via ESP, I guess.

    Literally, the most asinine post I’ve read.  So, if I’ve stumbled through your perception correctly:
    1.  We continue to allow all ILLEGAL activity, and do nothing
    2.  We actually punish ILLEGAL activity and put them in a tent city
    3.  Harass Anglo’s and require legitimacy
    Harass me all you want, if it helps in cleaning up this mess, I’m all for it.  I’d rather help pay for a tent city and legally house the criminal element than pay for the alternative.  As for the thousands and thousands of ILLEGALS you claim are evidently present, you provide no other alternative.  Apparently however, you fully support the rampant ILLEGAL activity.  What is wrong with you?

    So your way of getting rid of the problem is to hold our police officers hostige. People that our here illegal are committing a misdemeanor not a felony so the arresting police officer will have to sit around for hours waiting for the border patrol for processing. That sounds real smart the only people that are truely going to benefit are the felons, but hey maybe their republicans also.

    Seriously?? I am so tired of people whining about how illegals will have to show proof they are allowed to be in our country. We (LEGAL  citizens) have to show our driver’s license, registration, proof of insurance, passport, social security card, library card, etc., whenever we want any kind of service or are pulled over for even a moving violation.  The police have the authority to ensure the public’s safety and  LEGAL citizens comply with these requests all the time.  If someone wants to come to our country, I’m all for it.  They just need to do it LEGALLY so they can contribute their taxes to the services they are utilizing. Right now, they are not doing that.  ILLEGALS cannot have their pay taxed because they have no social security number/Green Card number/valid US citizenship paperwork allowing them to work in our country.  If they want to be in America, they need to do it the right way and our sorry excuse for government leaders need to enforce the laws already on the books.

    It is certainly relevant to point out that if SB 1070 does take effect and is fully enforced, it will create more problems than it solves.  In any case, it must not stand.  However it is written, when you look at it in the context of the “No Accents” law and the prohibition against ehtnic studies programs, it is clear the intent of the law.

      Illegals are already leaving Arizona! SB 1070 is ALREADY working and it hasn’t even been passed yet! Go figure.  The loss in criminal activity and savings of welfare, health care, etc costs should be significant. It’s just a shame that it took this long to finally happen. It will be interesting to see how long the sanctuary states and cities can hold out with the intense drain on their economies caused by the huge influx of illegal criminal freeloaders. Just look what they have already done to California! Look at Maywood, CA! That could be what all of the sanctuary cities will end up like. Then Arizona can laugh and know that we did the right thing!

I just went to Utah montana wyoming Idaho and did not  see trash anywhere it made me sick to  see what the illegals are doing to Arizona i can send you pictures you would be sick at what you see here . Let alone the fact there breaking the law not just mexicans all illegals .’ DO YOU ‘  ANY OF YOU THAT HAVE A COMPUTER  LOOK TO SEE WHAT IT COST IN TAXES WELFARE MEDICAL i guess not stop worring  about people that break the law and help the homeless we could use this money on . I know if i go to mexico and fly the american flag and protest ill get shot or go to jail and not a nice jail like here .     What a thoroughly weak and misinformed “article”. I’d like to suggest doing some fact-finding before you try and base a smear on a perfectly legal approach to keeping the system free of hangers-on. Your first two bullet points fall flat on their inaccurate and trumped up faces when the light of truth are shown on them.

    Naturalization is the acquisition of citizenship. Congress is granted power by the Constitution to make laws that say who is a citizen. There is no mention of “alien” or “illegal alien” or immigration. Congress has no power to regulate immigration, only citizenship.

    The 10th Amendment confirms this:

    “The powers not delegated to the United States by the Constitution, nor prohibited by it to the States, are reserved to the States respectively, or to the people.”

    The power to control immigration is not delegated to the Federal Government by the states. To do so would require a constitutional amendment.

    In other words,

    Naturalization/citizenship is under Federal authority

    The presence of non-US citizens in a state is up to the state, not the Federal Government.

    The Federal Government has no standing under which to sue Arizona.

    All congressional immigration legislation is an unconstitutional usurpation of powers which are reserved to the states.

    As for your third bullet point – that’s a tired, unfounded and once-again unfounded old dog that lives only in the minds of people that are are afflicted with greed via cheap labor exploitation, the lack of intelligence concerning matters of national securty or the fiscal health of the forced tax-paying public or some weird, perverse form of “white guilt”.

        Once again, your statement is misinformed or intentionally misleading.  No one’s talking about equal justice under the law.  Racial profiling is a red herring.  It’s forbidden by the law.  And a lot of the time, those who are whining most about racial profiling are whites who have “white guilt,” a psychological condition requiring professional treatment.

    The federal government’s lawsuit against Arizona over 1070 is hypocritical considering they have for years partnered with local law enforcement to capture illegal aliens. The federal 287(g) program has deputized 1,100-plus cops in 26 states to round up illegals , according to a story in the New York Post. Since 2006, more than 110,000 illegal immigrants have been ID’d and rounded up for deportation under the extremely successful federal-state partnership. “Local cops across the country are already directly involved in federal border security — the Obama administration just prefers not to acknowledge it.” Which means that the federal lawsuit is purely political.

      Yes, I suppose the 287 program has to go, too, in order to avoid charges of hypocrisy.  Hypocrisy, as we all know, is the province of conservative lawmakers who vote against equal rights for all Americans, then spend the night with their gay lover.

    An illegal is breaking the law by being here to begin with.  No scruples = no scruples, no matter how you try to paint it with a humanitarian brush.

Hispanics, Latinos, Blacks and Jews should start thinking about moving to their lands of origins, no more USA.
