Obama wants major federal role in home mortgages…just when you thought it was safe to come out of your storm shelter

by on Sep. 06, 2011, under economy, politics

The Washington Post  reported back in August that President Obama is trying to hatch a new plan for the federal government to keep a major role in the home mortgage business.

On mortgage rates, Obama wants proposal for how government can keep big role

President Obama has directed a small team of advisers to develop a proposal that would keep the government playing a major role in the nation’s mortgage market, extending a federal loan subsidy for most home buyers, according to people familiar with the matter.

COMMENTARY:

As Albert Einstein observed, the definition of insanity is doing the same thing over and over again and expecting a different outcome.

Here we go again…..

THE UPSIDE:

OK….the basic idea of providing low interest long term loans so people can own homes is a wonderful idea.

A big portion of our economy has been driven by home construction and home ownership going back to just after the end of WW II.

But like a lot of things federal, what started out as a good idea ended up  turning to dog vomit when people starting gaming the system.

One of the reason for the housing bubble that nearly crashed our economy was the idea that everyone ought to be able to own a home even if they really couldn’t afford it.

The whole “sub prime” mortgage business and federal policy was driven by the goal of expanding home ownership beyond where it could not support itself.

The first thing the feds are going to have to do is adopt a realistic level of what can be sustained in home ownership.

Maybe 30% of the population is not going to be able to own their own home…especially in light of the chronic unemployment. Don’t try to push home ownership where it is not feasible.

The second problem was the creation of “derivatives” whereby people could bundle up flakey mortgages and sell them off to unwitting investors.

This greatly expanded the pool of money to loan to home buyers and pushed a lot of people into homes because mortgage brokers and bankers wanted more and more commissions.

There may need to be a secondary market for home loans….which is one option for a fed role…but there have to be really tight rules about loan origination, qualification and appraisals. That whole system collapsed in the rush to write more mortgages and states don’t do a particularly good job regulating mortgage bankers and appraisers.

HUD FHA have all these standards for the actual home condition…and there is an opportunity for some interesting stuff with regards to new homes….rethinking whether or not a federally insured home loan for a house requires the house to have a garage versus maybe solar energy. I remember fussing with FHA over a requirement for landscaping trees in Tucson….trying to get them to quit demanding mulberry trees and accepting xeriscape instead.

A really important thing for the feds to do is not put the full faith and credit of US taxpayers behind home loans. That was a plank into the treasury the last time around.

One problem the feds will face is a lot of people have had their credit wrecked in the recession.

One idea is maybe a lease-purchase option where someone could lease a home, and if they make their payments on time for 3 years and repair their credit rating, then they would be eligible to exercise the option and purchase the home under the federal program. A program like this existed in California but got wiped out when sub prime loans started being made to people with no docs and no downpayment. No wonder everything went into the toilet.

Another element that ought to be considered is a combination home purchase loan and upgrade financing for existing housing…to retrofit existing housing with more energy efficiency like insulation and new windows…and maybe add a solar component.

It is going to take a while for the home building industry to recover…and it is essential to our economy that this sector does recover.

THE DOWNSIDE:

Next time around Washington has got to not force social policy into the mix, and Washington has got to keep the Wall Street pirates from ripping everyone off.

I think the first step of a new federal role in the home mortgage business is for the Obama Administration to single out the top 30 bad guys in all the mortgage fraud and charge them with massive federal crimes sufficient to lock their sorry butts up for life.

Lets perp walk some bankers, the Countrywide Bandits, some Fannie Mae and Freddie Mac co-conspirators, a few bond rating agency bosses, and other rascals.

The message has got to be clear that not only will us taxpayers not bail you asses out if you create a fraudulkent bubble, we will demand and get your asses thrown in jail.

Every banking and mortgage office should come complete not with pictures of hundred dollar bills or the Federal Reserve, but a photo of a maximum security federal prison.

And as part of a new mortgage system, mortgage fraud ought to be a capital offense.

I’ll bet whatever Obama comes up with will end up being more of the same old opportunity to scam the system and stick it to us taxpayers.

Tucson city manager resigns effective one year from now….new definition of chutzpah

by on Sep. 06, 2011, under politics

Michael Letcher, Tucson City Manager, resigned effective August 2012.

That’s right…his resignation is effective one year from now.

If that is not an excellent example of what has been wrong with the city of Tucson, if the Mayor and Council accept this resignation on those outrageous terms than you all really will understand what’s wrong with Tucson’s city government.

Tucson government basics: The city has 6 council members and a mayor. The mayor runs meeting and votes only to break a tie.

The Tucson charter puts the city council in charge of city policy…and implementing city policy is put in the hands of a city manager. The city council hires and fire the city manager who serves at the will of the city council majority.

Basically the city council is supposed to tell the city manager what the council wants done, and leave the administration of that up to the city manager and city staff.

However, in the 1980s  the city manager’s office usurped the policy role of the city council because Tucson’s elected officials were so busy mired in trivial pursuits, they wouldn’t understand “policy” if it ran them over on the street.

The policy options of the city council were manipulated by the city manager’s office. Elected city officials were never given all options, nor any kind of realistic views of the pros and cons of all possible policy options.

This is how the city ended up pissing away $230 million on Rio Nuevo with virtually nothing to show for it.

This is how the city’s ParkWise program has ended up as another scandal.

This is how the city can’t avoid feeding oleanders to its giraffes.

There is no one at the top of the pyramid saying this is what needs to be done and this better be done right or we’ll fire your ass.

Letcher has no civil service protection. At best he gets a few month severance pay if the council terminates him immediately. They should.

Between now and January the city can be run with an acting city manager until the election sort things out.

It is time for a sea change at city hall…which will only come if Republicans get two more council seats and the mayor’s chair. Three Democrats and three Republicans puts Rick Grinnell, if he is the next mayor, as the deciding vote.

Or, Tucson can continue to work really hard being a third class city run by Democrats who could care less what happens in Tucson east of Alvernon.
_____________________________________________________

Letcher notes in his resignmation email:

Unfortunately, I cannot change the current political and media climate in this community that focus more on blame than resolution. I know now that I can only go so far in changing the organizational climate of the city that has not seen consistent City Management since Joel Valdez.

Yep….and I worked for Joel Valdez 1974 to 1978 and here’s what Mr. Letcher is missing…..remember there was a police fire strike, and a recall over water rates in that time frame?

But Lew Murphy held solid as Mayor and Joel Valdez held solid as city manager.

Why was that”?

First Murphy had a vision for Tucson and knew his way around  even though the council majority shifted radically. He could get things done even if his majority Democrats fought. Muprhy was the last leader Mayor Tucson has had. He made it his point to know everything Valdez was up to and supported Joel to the ends of the earth.

When the majority Democrats drove the city off the cliff with their screwed up water rate hikes Valdez reconstructed the process by which city water rates were figured out…taking away the staff control over the process and putting more community input into the decision.

The city busted the police fire strike.

Ever since then Tucson has had a series of weak minded liberal mayors who pandered to all sorts of fringe issue communities and let the city continue to wrap itself in a spiderweb nightmare of regiulatory bullcrap. The staff took over the city.

Valdez ran the city for the benefit of the people…and even if he couldn’t count to four, he did what was right.

Since then city managers have pandered for votes from  officer holders with no vision of the entire city. These office holders have been too easly dazzled with statistics and expensive out-of-town consultants. City management in Tucson has become a medicine show act.

Anoither thing Valdezx diud that subsequent managers did not…Joel had a Deputyt city manager named Bill Ealy who ran all the infrastructure side of the city…public works, water…and Joel oversaw the services side of the city. There were not a lot of assistant managers.

Ealy was also Joel’s Enforcer. People feared Ealy. Screw up in a department and he’d have the department head in his office in a second, and if that department head didn’t fix the situation, he or she was gone.

Now when something screws up down the ranks there will be a study commission that will wander around until the offending staffer leaves town for a better job somewhere else.

Tucson needs a city manager who has an ax in the corner of his or her  office and who will be able to use it without some city council member throwing a snit fit.

by on Sep. 06, 2011, under border issues, border patrol, border patrol tucson sector

Press Release from US Customs and Border Protection September 6, 2011:

Significant Week Sonoita Border Patrol Station Seizes

More Than 3,000 Pounds of Marijuana

TUCSON, Ariz.Sonoita Station Border Patrol agents seized approximately 3,250 pounds of marijuana valued at more than $1,625,500 in five separate incidents since Sunday.

A Border Patrol canine team was tracking footprints of a group of possible illegal aliens Sunday when the service canine alerted to the presence of narcotics. An immediate search of the area revealed six bundles of marijuana abandoned on the trail. The bundles had a combined weight of just less than 279 pounds and valued at $139,000.

In another incident Sunday, agents responded to a detection sensor and found five bundles of abandoned marijuana weighing more than 218 pounds. The bundles were estimated to be worth approximately $109,000.

Agents stopped two vehicles Tuesday traveling in tandem and with false vehicle license plates. The female driver of the first vehicle, a U.S.citizen, was detained when agents discovered a false compartment in the vehicle containing 53 packages of marijuana weighing more than 312 pounds and valued at $156,000. Concurrently, agents stopped the second vehicle and apprehended two male passengers who admitted to working with the female driver of the first vehicle. The three subjects are being criminally prosecuted.

Wednesday afternoon, an agent encountered an abandoned pickup truck with 75 bundles of marijuana weighing 1,840 pounds and valued at $920,000.

In another incident Wednesday, Sonoita agents stopped a suspicious vehicle with modifications indicative of narcotics smuggling. Agents interviewed the driver, a Mexican citizen with a Permanent Resident Card, who gave agents permission to search his vehicle. After a Border Patrol canine team alerted to the presence of narcotics, agents discovered 60 packages of marijuana in a concealed compartment. The packages had a combined weight of almost 282 pounds and with a value of $140,500. The driver is being held for prosecution.

In each incident, agents transported the marijuana and vehicles to the Sonoita Station for processing.

According to Michael Hyatt, Patrol Agent in Charge of the Sonoita Station, the Tucson Sector deploys a combination of technology, infrastructure, and agents to effectively patrol the border, deter smuggling activity and interdict smugglers.  Specialty units, such as canine teams,” he said, “continue to assist agents in the field while old-fashioned tracking skills continue to be a valuable component in the Border Patrol’s arsenal of tools and techniques. The men and women of the Sonoita Border Patrol Station are taking our enforcement efforts to the next level.”

Since launching the Southwest Border Initiative in March 2009, the Department of Homeland Security has made significant investments toward establishing a secure and safe border environment to improve the quality of life throughoutArizonacommunities.

Customs and Border Protection welcomes assistance from the community.  To report suspicious activity to the Border Patrol by calling 1-877-872-7435 toll free. All calls will be answered and remain anonymous.

U.S. Customs and Border Protection is the unified border agency within the Department of Homeland Security charged with management, control and protection of our nation’s borders at and between official ports of entry. CBP is charged with keeping terrorists and terrorist weapons out of the country while enforcing hundreds of U.S. laws.

Illegal workers got $4.2 billion in tax credits

by on Sep. 06, 2011, under border issues

The Washington Post reported that undocumented workers got $4.2 billion in tax credits last year.

Undocumented workers got billions from IRS in tax credits, audit finds

The Internal Revenue Service allowed undocumented workers to collect $4.2 billion in refundable tax credits last year, a new audit says, almost quadruple the sum five years ago.

Although undocumented workers are not eligible for federal benefits, the report released Thursday by the Treasury Inspector General for Tax Administration concludes that federal law is ambiguous on whether these workers qualify for a tax break based on earned income called the additional child tax credit.

Here’s FoxNews on the story:

Illegal Workers Used Tax Credit to Pocket $4.2 Billion, Audit Shows

Talk about a tax loophole.

Undocumented workers collected $4.2 billion in a certain tax credit last year, up from less than $1 billion five years ago, according to a new audit.

The report from the Treasury Inspector General for Tax Administration looked only at a tax benefit known as the Additional Child Tax Credit, a refundable credit meant for working families. The audit found that as a result of vague U.S. law — as well as an expansion of the tax credit in stimulus legislation and other measures — the number of illegal workers collecting the money has skyrocketed.

Read more: http://www.foxnews.com/politics/2011/09/02/undocumented-workers-pocketed-42-billion-in-tax-credits-audit-shows/#ixzz1XBZgZuaz

COMMENTARY: So the illegal alien gets a tax id number because he does not have a Social Security number, files a tax return, and gets the child credit paid.

Someohow I cannot believe for a second this is some kind of accident…illegal aliens are gettng some pretty sophisticated help in getting taxpayer id numbers and gaming the system for the tax credit.

It is a crime in this country to aid and abet illegal entry…thus if you pick up an llegal alien and give him a ride you can go to jail.

How about the crime of aiding and abetting tax fraud and illegal residency?

Center for Biological Diversity opposes effort to improve border security

by on Sep. 06, 2011, under border issues, Center for Biological Diversity

This Press Release from, Center for Biological Dioversity dated September 2, 2011 makes it absolutely clear where CBD’s priorities are…

Border Patrol Plan to Triple Base Size on Arizona-Mexico Border Puts Endangered Wildlife, Fragile Lands at Risk

TUCSON, Ariz.— The Center for Biological Diversity today criticized a new environmental analysis by the Department of Homeland Security that fails to adequately assess the effects of its border-security and enforcement activities along the U.S.-Mexico border, including tripling the size of its base in the desert. In comments submitted to the Department, the group called on Homeland Security to produce a thorough, realistic analysis of the impacts of its activities on the fragile and diverse landscapes of the border region, home to a range of threatened and endangered species.

“In its slipshod analysis of the impacts of tripling the size of its forward operating base near Organ Pipe National Monument and Cabeza Prieta National Wildlife Refuge, Homeland Security seems to condone ongoing damage to these precious public lands and their wildlife,” said the Center’s Cyndi Tuell. “For imperiled species like Sonoran pronghorns, this lip-service study is a death knell.”

Organ Pipe and Cabeza Prieta lie adjacent to each other along the U.S.-Mexico border in Arizona and have been significantly hurt by off-road vehicle use in recent years — much of the damage has been the result of Border Patrol vehicles riding roughshod over wilderness areas.

“For an agency devoted to securing the border, the Border Patrol does an awful lot of off-road driving 15 to 20 miles north of the border, through extremely sensitive habitat for a range of species,” said Tuell. “Sonoran pronghorn are especially vulnerable to this kind of disruption, which can stop them from raising their fawns or getting enough to eat.”

Surveys and satellite data show that nearly 8,000 miles — and some estimate up to 20,000 miles — of illegal, “wildcat” roads now exist on the Cabeza Prieta, some of which were created by illegal cross-border vehicle activity, but an increasing percentage of which have resulted from misguided enforcement strategies.

“A memo of understanding between Homeland Security and the Department of the Interior was signed to create protocols for border-security activities on our precious public lands,” said Tuell. “In many places it works well, but on Organ Pipe and Cabeza Prieta, Homeland Security routinely ignores it.”

“The Department of Homeland Security should focus its enforcement efforts closer to the border to prevent damage to America’s public lands before it encroaches so far into the United States,” said Tuell. “And it needs to work more closely with land managers on the ground in these areas to reduce the damage caused by their activities.”

COMMENTARY: The border will never be secure against illegal entry and drug smuggling as long as portions of the border are widen open.

The reason these areas are wide open is because of federal land managers who put protecting lizards ahead of national security, and radical environmental groups like CBD who fight everything in the name of protecting endangered species.

I think it is time the federal government looks into where CBD gets its donations.

If I were in charge of the Mexican drug cartel I’d be giving money to outfits like CBD which fight securing the border. Groups like CBD consciously or unconsciously are aiding and abetting the Mexican drug cartels.

The people of America have got to stop this nonsense of debating border security versus proptecting the environment along the border. The drug smugglers and illegal aliens do not care about our environment and are destroying it. This must be stopped.

Environmental laws must be subordinated to national security in the area adjacent to our land borders so the Border Patrol can secure the border at the border.

Did you know it is a misdeamnor to illegally enter the country, but a felony to run over an endangered species lizard?

And those who want immigration law reform…it ought to be clear that is not going to happen until the border is secured.

Do not buy Janet Napoltiano’s claim the border is secured. We can show you exactly where it is not secure…the zone where illegal aliens killed Border Patrol agent Brian Terry west of Nogales. There is a wilderness area and national forest land along this stretch of the border that has virtually no Border Patrol access due toi environmental priorities.

Until the Border Patrol can gain access to the border, finish the fence, put in more roads, and saturate the border zone with agents, the border is not secure…and thus no immigration law reform.

Immigration reform advocates…your cause is being destroyed by groups like the Center for Biological Diversity.

Feds sue 17 banks over mortgage backed securities…. “we want our money back”

by on Sep. 02, 2011, under politics

Press Release from Federal Housing Finance Authority September 2, 2011:

FHFA Sues 17 Firms to Recover Losses to Fannie Mae and Freddie Mac

Washington, DC

– The Federal Housing Finance Agency (FHFA), as conservator for Fannie Mae and Freddie Mac (the Enterprises), today filed lawsuits against 17 financial institutions, certain of their officers and various unaffiliated lead underwriters. The suits allege violations of federal securities laws and common law in the sale of residential private-label mortgage-backed securities (PLS) to the Enterprises.

Complaints have been filed against the following lead defendants, in alphabetical order:

1. Ally Financial Inc. f/k/a GMAC, LLC

2. Bank of America Corporation

3. Barclays Bank PLC

4. Citigroup, Inc.

5. Countrywide Financial Corporation

6. Credit Suisse Holdings (USA), Inc.

7. Deutsche Bank AG

8. First Horizon National Corporation

9. General Electric Company

10. Goldman Sachs & Co.

11. HSBC North America Holdings, Inc.

12. JPMorgan Chase & Co.

13. Merrill Lynch & Co. / First Franklin Financial Corp.

14. Morgan Stanley

15. Nomura Holding America Inc.

16. The Royal Bank of Scotland Group PLC

17. Société Générale

These complaints were filed in federal or state court in New York or the federal court in Connecticut. The complaints seek damages and civil penalties under the Securities Act of 1933, similar in content to the complaint FHFA filed against UBS Americas, Inc. on July 27, 2011. In addition, each complaint seeks compensatory damages for negligent misrepresentation. Certain complaints also allege state securities law violations or common law fraud.

As conservator of Fannie Mae and Freddie Mac, FHFA is charged with preserving and conserving these companies’ assets and does so on behalf of taxpayers. The complaints filed today reflect FHFA’s conclusion that some portion of the losses that Fannie Mae and Freddie Mac incurred on private-label mortgage-backed securities (PLS) are attributable to misrepresentations and other improper actions by the firms and individuals named in these filings. Based on our review, FHFA alleges that the loans had different and more risky characteristics than the descriptions contained in the marketing and sales materials provided to the Enterprises for those securities.

FHFA filed the complaints under the broad authority granted to it by the Housing and Economic Recovery Act of 2008. The U.S. legal system provides for addressing such alleged misrepresentations through the nation’s securities laws and traditional common law. FHFA is following those legal remedies in filing these complaints and seeks to recover on losses to the Enterprises that are the legal responsibilities of others.

Discussions regarding these matters have taken place with several of the firms receiving complaints and, where constructive, they will continue.
